INFORMED CONSENT/ASSUMPTION OF RISK/WAIVER/RELEASE/INDEMNITY AGREEMENT

I understand and acknowledge that the nature of bicycling activities requires physical effort and poses a risk of exhaustion, stroke, and heart attack, as well as serious bodily injury, including permanent disability, paralysis and death.  I understand the special dangers associated with bicycling on open public roads, which risks include, but are not limited to:  collisions with animals, pedestrians, vehicles, cyclists, and other fixed and moving objects; the dangers of surface hazards and weather conditions, pot holes, rail road tracks, broken roads, rocks, sticks, obstructions and debris, slippery surfaces, lightening, wet, wind, heat, cold, and things falling from trees; equipment failure; inadequate or absent safety equipment; or contract a virus or communicable disease.  I know that these risks and dangers may be caused by my own actions, or inactions, the action or inactions of others participating in the activity, the condition in which the activity takes place, or the negligence of those entities being released below.  I know there may be other risks and damages and social economic losses either not known to me or not readily foreseeable at this time. Knowing the many risks, I assume all risks, and relieve the entities identified below from any and all responsibility for any injury or damage that may occur.  

I further agree and promise that if any time I believe conditions to be unsafe, I will immediately discontinue further participation in the activity.  I agree to follow the Illinois Rules of the Road and use special care for myself and others present. I agree to wear a helmet while on a bicycle. I am adequately trained to complete the route I have chosen to ride.  I agree to cooperate to "share the road" and agree not to ride two or more abreast when it impedes traffic.

After being informed of, and assuming all risks, and in consideration of being permitted to participate, in any way, in a Kankakee River Bike Club sponsored bicycling activity, for myself, my personal representatives, assigns, heirs, and next of kin, I hereby RELEASE, DISCHARGE, AND COVENANT NOT TO SUE, Kankakee River Bike Club, Watseka Park District, their respective administrators, directors, agents, officers, volunteers, and employees, other participants, any sponsors, advertisers, or owners or lessors of premises on which the activity takes place. (Each considered a “released entity” herein) AND I RELEASE FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON MY ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE RELEASED ENTITY OR OTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATIONS;

AND I FURTHER AGREE that if despite this release and waiver of liability, assumption of risk, and indemnity agreement, I, or anyone on my behalf makes a claim against any released entity, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASES from any litigation, expenses, attorney fees, loss liability, damage, cost which may occur as a result of such claim.  I also authorize the Kankakee River Bike Club to use photographs taken at and around the activity for marketing and to release my demographic information to sponsors of the activity, and others, but not to sell to or use with other parties not involved with the planning or execution of such activity.

I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I WILL GIVE UP SUBSTANTIAL RIGHTS BY SIGNING IT AND NOW SIGN IT FREELY AND WITHOUT INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS TO BE HELD INVALID THE BALANCE NOTWITHSTANDING SHALL CONTINUE IN FULL FORCE AND EFFECT.  (revised 5/5/2020)
